GYM COMPANY GYM4FREE REWARDS PROGRAMME TERMS AND CONDITIONS

 

GENERAL

  1. The gym4free programme ("the Programme") is brought to you, the member, ("you", “your”) by Gym Company ("us", "we", “our”).
  2. It is important that you read these terms and conditions carefully to ensure you know and understand what you can expect from us and the Programme. The latest version of these terms and conditions is available online and accessible at https://www.gymcompany.co.za/terms.
  3. By joining the Programme, you are agreeing to these terms and conditions, as amended from time to time by us. These terms and conditions constitute an agreement between you and us and govern your and our rights and obligations as a registered member of the Programme. We reserve the right to terminate your membership at any time if we believe that you have participated fraudulently or contravened these terms and conditions or the law in general.
  4. We reserve the right, from time to time, to restrict, terminate, suspend, or alter aspects of the Programme and these terms and conditions with or without prior notice to you. Any changes will be effective immediately, unless stated otherwise. We will attempt to notify you of any major changes but will not be held liable for any failure to do so. Should we decide to terminate the Programme, this will not affect any benefits granted to you prior to the date of such termination.
  5. We shall be entitled to cede, assign, delegate or in any other way dispose of any or all its rights and obligations in terms of the Programme without your prior consent.
  6. Failure by us to enforce any of our rights at any stage does not constitute a waiver of those rights.

REGISTRATION

  1. Membership to the Programme is free of charge.
  2. To register, you must be an active Gym Company member.
  3. You will only be able to register for the Programme online. The registration page can be found here: https://www.gymcompany.co.za/gym4free.
  4. You may only have one active membership at any time.
  5. To successfully register as a member, you will need to provide us with the following information: your full name and surname, cell phone number, email address and consent to market to you.
  6. Your gym4free benefits may be suspended if your membership is in arrears.
  7. You may terminate your membership at any time by notifying us via email at support@gymcompany.co.za or by calling us on 0800 333 333 or by visiting any Gym Company branch and informing one of our staff members that you wish to terminate your membership.

 

BENEFITS OFFERED TO YOU FOR BEING A MEMBER OF THE PROGRAMME

  1. The benefits we offer you are not transferable to other members of the Programme.
  2. As a registered member, you will earn cashback for:
    1. Successfully referring your friend(s) to join Gym Company. Your referred friend(s) will receive an SMS & email (if you provided their email address) from us confirming that you referred them. One of our consultants will call your referred friend(s) and will set up an appointment at their nearest Gym to activate their membership. Once the membership has been activated and the first payment has been collected, you will receive one free month’s membership which will be paid into your gym4free cashback wallet.
    2. Purchasing airtime and data on the gym4free website or gym4free mobile app. This benefit be made available from time to time and will apply to participating cell phone networks (which we will detail). You can purchase airtime for yourself and your friends on our website or on the gym4free mobile app, and you will be rewarded with cashback for doing so. This cashback will be paid into your gym4free cashback wallet.  
    3. Purchasing products and services from us and/or from our gym4free cashback benefit partners (“Cashback Partners”):
      1. By uploading valid till slips as proof of purchase. You can either scan a slip using your cell phone or upload an existing slip from your cell phone’s gallery. Our system will validate, verify, and approve all till slips submitted by you and load the cashback into your gym4free cashback wallet. All slips need to be clear and show the products purchased, store name, purchase date and till slip total. Please do not write on the slips. Please keep your slips as a backup.
      2. Automatically when you purchase products on our website or on the gym4free mobile app. For these purchases you will NOT need to upload a till slip.
  1. Refunds, returns and exchanges for products purchased on our website or on the gym4free mobile app.
    1. Power Shoes
      1. Exchanges
        If you are not entirely satisfied with your purchase and wish to exchange your shoes for another pair, then you will be required to return them to the gym where you collected them. We offer product exchanges within the first 20 days after delivery of your shoes. If more than 20 days have passed since you took delivery of your shoes, then you will not be offered an exchange.
      2. Warranty Claims
        All customers are allowed 6 months from the date of delivery to return shoes if they are defective. We will then either replace the shoes with a new pair or offer you a full refund of the purchase price. If we refund you, then we will clawback the gym4free cashback that was allocated to your gym4free wallet.
      3. Refunds
        We do not offer refunds for shoes purchased unless the reason for the return is due to a defect.
      4. For Both Exchanges and Refunds
        Your first step will be to contact us via the “Speak to us” section on our mobile app. That way we will be able to track the progress. You will be required to return the shoes in their original packaging to the gym from where you originally collected them. You will also need to provide a copy of the purchase invoice for the shoes: this should be included in the return package. Securely seal the package before handing it over to the staff at the gym. You will need to confirm the style and size of the replacement shoes when returning the returned shoes to us. We will send your returned shoes to our supplier and order your replacement pair. If you are returning a defective pair of shoes and want a refund, then you will need to state this when you log your query on the “Speak to us” section of our mobile app and again to the staff member at the gym. Our supplier will have the right to inspect the shoes that you returned before sending you a replacement pair or before processing your refund.
    1. Evolve Nutrition
      1. Exchanges
        We offer product exchanges within the first 20 days of you collecting your supplements from us. If more than 20 days have passed since you collected your supplements, then you will not be offered an exchange.

        Your first step will be to contact us via the “Speak to us” section on our mobile app. That way we will be able to track the progress. If you wish to exchange your supplements for other supplements, kindly return them to the gym from where you originally collected them. Please ensure the supplements are unopened and are in their original packaging and include a copy of the purchase invoice in the package. Securely seal the package before handing it over to the staff at the gym. You will need to confirm the new supplements that you would like to receive. We will send your returned supplements to our supplier and order your replacement items.

      2. Refunds
        We do not offer refunds for products purchased for us unless the reason for the return is due to a defect.
  1. All cashbacks will be paid into your gym4free cashback wallet.
  2. No cashback will be earned in respect of any products or services where the earning or awarding of such cashback are prohibited by any legislation in the Republic of South Africa.
  3. We reserve the right to deduct any cashback from your gym4free cashback wallet that has been incorrectly allocated to you, for whatsoever reason, even if this results in a negative account balance after the deduction has been processed. We shall not be liable for any claims or losses in this regard. 
  4. The cashback in your gym4free wallet will be automatically redeemed by our system as payment for your Gym Company monthly fees. Once the balance in the wallet is equal to or the same as your monthly subscription due, we will automatically and immediately trigger the deduction – without any action required by you. You will not be able to withdraw this cashback or exchange it for cash or vouchers. This redemption may take up to a month to be process which may mean that your free monthly subscription will only show in the month following the redemption.
  5. If you do not earn cashback from us for a period of 12 months, your Programme membership will be deemed to be dormant. The unredeemed cashback balance in your dormant account will expire and be reclaimed by us, and as a result your cashback balance will have a zero balance.
  6. We have engaged with a range of Cashback Partners as part of our Programme proposition. Cashback received by you for goods or services purchased from Cashback Partners could take up to a month to be paid into your cashback wallet. We reserve the right to add new Cashback Partners or end the relationship with Cashback Partners or change the nature of Cashback Partners at any time.
  7. In addition to the cashback that you earn as a member of the programme, you may also receive additional benefits from time to time, including promotional and special gym4free member discount offers on a range of products or services. These promotional offers may include additional terms and conditions, which will be communicated as part of the offer. All promotional offers are subject to availability.
